Drinking, smoking, joining the army, having sex, all have different age limits. I would say there should be some type of staggered law where a society would educate everyone to it's dangers and more importantly affects. Then 16 year olds could eat the herb with parental supervision. (similar to a law in the UK which allowed 16 year olds to drink in pubs if with a parent or guardian but 18 without) Smoking it should be 18 IMO. (which is a little hypocritical as I smoked it at 16). The thing is kids will smoke herb. We as a society that needs to evolve to stop punishing and criminalising children for curiosity when there are little to no victims of the crime (except those which are born of lack of education and criminalising the drug in the first place).
