How Is Medical Marijuana Even Legal?
How do some states make medical marijuana legal, if U.S. Law says that *any* sort of possession of it is a criminal offense?
I’ve been reading statutes from different states that mention that it’s not criminal to possess marijuana under a physicians prescription for a terminally ill, or otherwise ill patient.
Can’t the FBI/DEA still bust you under U.S. Law?



Yes, federal agents can still arrest you under U.S. law, regardless of state law.

Yeah unfortunately they can bust you, but the DEA and FBI wont bother you much at all if you’re not selling it. That what they deal with. The DEA field office is right next to my school and i was having a cigarette out in the parking lot with a DEA agent he told me me he can see people blazing all the time. I asked why he doesn’t bust them but “his badge says ‘Narcotics Agent’ not ‘Pot Cop.’” They dont care much about the everyday pot smoker, they wanna go after the source.
The CA state laws (SB420 and Prop. 215) basically state that if you have a medical card you can have up to one ounce of cannabis on you at a time. The state and local police and he CHP cant bust you if you have a card and are following the state laws because they don’t enforce federal law but rather state laws. but a federal agent could theoretically bust you under the federal laws, but like i said before, i don’t think they want to waste their time with a single stoner.

It technically isn’t legal.
However, the DEA chooses not to bust these people because they know no good will come of it. No point in arresting a cancer patient that’s just trying to feel OK.
Then there is the whole Oaksterdam thing, where in Mandacino(sp?) county in California there are stores which you can buy it in and it is extremely easy to get medical marijuana. Ever since they made it legalized there(still not technically legal), the economy has become much better. The DEA is not going to bust them because their economy would collapse and it would become a run down horrible place to live in once more.

A better Q is why is marijuana illegal at all. The A: because the liquor lobby and organized crime pay our elected representatives to keep it that way, thereby increasing their profits.
I don’t use any drug stronger than beer, but if I decided to do so, the liquor lobby and organized crime would have no bearing on my decision.

yes the fbi and dea can still bust you. but the feds dont have infinite resources like they want to believe. we are in a federalist state of government that has a federal government as well as a state government the state government can choose to not prosecute laws that the federal government does.
